These terms and conditions apply to the purchase of goods on www.simplychocolate.dk for delivery in www.simplychocolate.dk. The right of withdrawal only applies to private consumers who shop via www.simplychocolate.dk.
Payment and delivery
On www.simplychocolate.dk we accept payment with:
- VISA
- VISA Electron
- Mastercard
- Maestro
- JCB
We also accept the payment methods:
- MobilePay
The amount is only charged when the item is shipped. If You have ordered several items and one of the items is on backorder, we will only charge for that item when it is shipped.
Prices are stated in Danish kroner and include Danish VAT. In addition to the price, the cost of shipping must be added. You choose the shipping method at the end of the ordering process. Any payment fees are covered by us.
Reservation of amount
If You pay with an international payment card, the amount is reserved immediately. The money is reserved on Your card or account until:
1) We charge the amount when we ship the item, or
2) the money is released according to the agreement with Your card issuer.

We do not charge card fees.
Receipt of order and order confirmation
When You have ordered an item from us, You will receive a receipt (order confirmation) via email confirming that we have received Your order.
Shipping and delivery
We send all packages through our subcontractor Coolrunner, which allows You as a customer to choose between a number of different shipping companies.
Delivery time in Denmark is typically 1-3 business days.
- Parcel locker: DKK 39,-
- Home delivery: DKK 49,-
Delivery time outside Denmark is typically 3-6 business days.

Track & trace
All our packages are insured and come with a track & trace number. When Your package is shipped, You will receive an email with tracking information that allows You to track Your package.
Returns and withdrawal
As a consumer, You have a 14-day right of withdrawal when shopping with us.
The withdrawal period expires 14 days after the day You have received Your item or we have entered into an agreement for a service.
ItemsIf You have ordered several different items in the same purchase, but they are delivered individually, the period runs from the day You receive the last item.
If the purchase consists of several batches or parts, the withdrawal period expires 14 days after the day You receive the last batch or part.
The deadline means that You have 14 days from receipt or the day we made the agreement to notify us that You want to withdraw the agreement. You can send an email to kundeservice@simplychocolate.dk or use the standard withdrawal form, which You can find at the bottom of the terms and conditions.
You cannot withdraw the purchase by refusing to accept the item without simultaneously notifying us.
How to exercise Your right of withdrawal:
You withdraw by notifying us that You withdraw via e-mail: kundeservice@simplychocolate.dk.
You cannot withdraw by refusing to accept the item or by failing to collect it without simultaneously notifying that You withdraw. Danish customers can use the statutory standard withdrawal form, but it is not mandatory. You can find the form by clicking here: withdrawal form
The withdrawal period is met if You send Your notice of withdrawal before the withdrawal period expires.
Returning the item and return costs
If You have regretted the purchase of an item, You must send or deliver the item to us without undue delay and no later than 14 days after You have informed us that You wish to withdraw Your purchase. The deadline is met if You return the items within the 14 days.

In the return package, You must include a copy of the order confirmation, invoice, or other documentation of Your purchase.
Items cannot be sent cash on delivery or without delivery, and You must pay for the return of the item Yourself. You should also ensure that the item is properly packed when You return it. You bear the risk for the package/items until we receive it. Therefore, keep the postal receipt and any track and trace number.
No right of withdrawal
These agreements cannot be withdrawn:
Delivery of sealed goods which, for health protection or hygiene reasons, are not suitable for return, and where the seal has been broken after delivery.
Simply Active: Agreements on accommodation, but not for residential purposes, transport of goods, car rental, catering, or leisure offers, when the date or period is agreed. (The latter can, for example, be courses, performances, competitions, etc.)
Refund of money upon withdrawal
If You regret the agreement, You will get Your money back, including any delivery costs. However, this does not apply in the following cases:
If You have purchased multiple items in one order and only regret part of Your purchase, we will not refund the delivery costs. However, if You have chosen a delivery method that is more expensive than the cheapest delivery option we offer, You will not be refunded the extra cost.
If the item is depreciated, we will deduct the amount You are liable for.
We will refund the amount without undue delay and in any case no later than 14 days from the date we received Your notice of withdrawal. However, we may withhold the refund until we have received the items back or You have provided proof that the items have been returned.
We will make such a refund using the same payment method You used for the original transaction unless You have expressly agreed otherwise. In any case, You will not be charged any fees as a result of the refund..
Testing of the item and packaging
You are only liable for any reduction in the item's value caused by handling the item in a way other than what is necessary to determine the nature, characteristics, and functioning of the item.
You may normally examine the item in the same way as You can and may in a store, but You must not use it. If You have used it in a way that is not allowed or possible in a store, and we cannot sell it again at full price, You can expect that we will deduct the reduction in value from the amount You are to be refunded. If the item no longer has commercial value, we will not refund the purchase amount. The amount You can get back depends on the item's commercial value, and in some cases, this may mean that You only get the shipping costs back.
The item should be returned in intact original packaging. If the original packaging is missing, this may result in a reduction in the item's value. You should also ensure that the item is properly packed when You return it. You bear the risk for the package/items until we receive it. Therefore, keep the postal receipt and any track and trace number.

Complaint - If there is something wrong with the item
As a consumer, You have a 24-month warranty period. This means that if the item has a defect and You complain in time, You are entitled initially to have the item repaired or replaced. If this is not possible or does not happen within a reasonable time, You may, depending on the circumstances, get a refund or a price reduction.
A defect is, for example, a manufacturing or material fault, or incorrect information about the item. However, normal wear and tear or damage You have caused to the item is not a defect. If You discover a defect, You must complain to us "within a reasonable time." We recommend that You complain as soon as possible, especially if it concerns transport damage.
If You complain within 2 months after the defect is discovered, it is always considered within a reasonable time. If the complaint is justified, we will refund Your reasonable and necessary shipping costs.
If You believe the item has a defect, please describe the problem as detailed as possible.
Remember that the item must always be sent in proper packaging and that You get a receipt for the shipment. Keep the postal receipt including information about shipping costs and any track and trace number.

When You return the item, please include a detailed description of the problem.
Shelf life
There will always be a minimum of 2 months' shelf life on the goods we sell online. You can see the shelf life on the back of the product. It is indicated in months and shows a shelf life until the last date of the given month. For all goods (including goods with limited shelf life), normal wear/decay is not a defect under the Sale of Goods Act, even if wear/decay occurs before the expiry of the 2-year warranty.

A complaint about a good or service can be submitted to the Mediation Team for Consumer Complaints, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Mediation Team for Consumer Complaints via the Complaint Portal for Nævnenes Hus.
If You reside in Denmark and have traded with a seller outside Denmark but within the EU, Norway, Iceland or the United Kingdom, You can complain to Consumer Europe here
